Property settlements can be delayed for a variety of reasons, but few rage on quite like this case of a homeowner caught in a two-year dispute over caveat priorities.
The Problem | Sale Proceeds Stuck in Limbo
Our client, the wife in a joint tenancy, had sold her property with her husband. However, due to various proceedings against the husband (and in some cases, both of them) The court ordered the sale proceeds to be held in our trust account until either a written agreement was reached, or a further court order was made.
Two caveats had been lodged over the property, creating a priority dispute between the caveators. Unfortunately, the issue was not about whether the property should be sold, it already had been, but about who had the stronger claim over the sale proceeds.
The Challenge | A Costly, Prolonged Stalemate
For nearly two years, the funds sat untouched while the dispute dragged on, Previous mediation attempts had failed. Legal costs were mounting for all involved, and our client’s money remained locked away despite her willingness to resolve the matter.
Our Strategy | Settlement Over Trial
Rather than push for a lengthy expensive trial, we focus on finding a cost-effective resolution we:
- Negotiated with the other side to re-open discussion
- Proposed and arranged an informal settlement conference rather than formal court proceedings
- kept the discussions targeted to the single outstanding issue (The priority of the Caveators) to avoid unnecessary complexity
This approach meant all parties could speak frankly about their positions without incurring the significant expenses and risks of trial.
The Outcome | A Practical Resolution
The Settlement conference was a success. The Parties reached an agreement, and our client recovered a portion of the funds that had been frozen for almost two years. while not the full amount she had hoped for, the outcome avoided further legal costs and allowed her to finally move on.
