Our client, acting as an agent for the mortgagee, needed to recover a debt from a mortgagor who had fallen behind on their obligations. As negotiations stalled, it became necessary to take legal action to obtain possession of the property in question. The challenge? Balancing the legal process of enforcement with the possibility of a last-minute settlement that could avoid eviction.
The 4 strategic Moves We Used
Our team took swift and decisive legal action to protect our client’s interests. Here’s how we handled the matter:
- Obtaining a Court order, we Successfully obtained a court order granting our client possession of mortgagor’s property.
- Securing an Enforcement Warrant, to enforce the court order, we applied for an were granted an Enforcement Warrant for possession of the land. This legal step allowed us to process with recovering the property on behalf of our client
- Coordinating with the Bailiff, our team worked closely with the Bailiff to ensure all necessary steps were taken for the lawful eviction process
- Negotiating a Settlement, while preparing for enforcement, we remained in constant communication with the debtor’s solicitors. Despite the legal proceedings in motion, we were committed to reaching an amicable solution to prevent eviction.
The Outcome; A last minute win for our client
Just as enforcement was set to proceed, our persistence in negations paid off. At the eleventh hour, we successfully reached a settlement that allowed our client to recover the outstanding debt, without needing to evict the debtor. This outcome not only secured our client’s financial interests but also provided a more positive resolution for all parties involved.
